Version: Ovtober 2026 / Updated for Event Season
This document affects your legal rights, including your ability to seek compensation in the event of injury, death, or loss. If you are uncertain about or uncomfortable with any part of these Terms and Conditions, seek independent legal advice before registering.
By completing registration via the KISA online entry system, you acknowledge and agree that you have read, understood, and accepted these non-negotiable Terms and Conditions in full. For entrants under 18 years of age, a parent or legal guardian must review and accept on their behalf.
I acknowledge and agree that these Terms and Conditions may be amended from time to time at the sole discretion of KISA without prior notice.
I elect to participate in the Event entirely at my own risk. I acknowledge that open-water swimming involves inherent and significant risks, including the danger of serious personal injury, permanent disability, and death. These risks may arise from factors including, but not limited to:
Physical overexertion, dehydration, hypothermia, cardiovascular distress, or heart attack;
Submerged debris, reef hazards, shallow waters, and dangerous marine fauna;
Unpredictable weather, sea, swell, and tidal conditions;
Equipment failure; and
Collisions or incidents involving other competitors, watercraft, spectators, or members of the public.
I acknowledge that applicable civil liability legislation restricts my right to recover damages where I voluntarily participate in a recreational activity carrying inherent risks. Accordingly, I fully release, acquit, and forever discharge KISA, its committee, directors, officers, agents, contractors, volunteers, and associated entities from any and all liability for personal injury, illness, loss of life, or property damage sustained as a result of my preparation for, entry into, or participation in the Event.
I certify that I am an experienced, capable swimmer in open water. I agree not to enter the water unless I am in peak physical condition and have trained sufficiently. I verify that:
A medical practitioner and/or qualified swim coach has assessed my fitness to compete;
I am in sound health and have no undisclosed medical conditions that compromise my safety; and
I am capable of treading water in a fatigued state for a minimum of three (3) consecutive minutes.
To ensure participant safety, entrants in the 20 km and 6 km solo distances must satisfy the following mandatory qualification standards before their entry is confirmed:
20 km Individual Swim: Must have completed a 10 km swim in under 4 hours. This may be an official event result or a verified, recorded solo/training swim (e.g., GPS track via Garmin, Strava, or equivalent showing elapsed time and distance). Any official race result exceeding 10 km is also accepted.
6 km Individual Swim: Must have completed a 3 km swim in under 2 hours. This may be an official event result or a verified, recorded solo/training swim (e.g., GPS track via Garmin, Strava, or equivalent showing elapsed time and distance). Any official race result exceeding 3 km is also accepted.
KISA reserves the right to request proof of qualification and may revoke race registration without refund if acceptable verification is not provided upon request.
I agree that these terms shall be interpreted broadly to afford the maximum indemnity, waiver, and release allowable by law in favor of KISA and all related parties.
I agree to indemnify, defend, and hold harmless KISA, its executive committee, race directors, sponsors, event partners, medical staff, water safety teams, volunteers, contractors, and relevant statutory or land-management authorities against any actions, claims, damages, demands, liabilities, costs, and expenses (including legal fees on a full indemnity basis) arising from my participation, whether resulting from negligence, breach of contract, or any other cause. This waiver binds my heirs, executors, administrators, next of kin, and legal representatives indefinitely.
If I withdraw from the Event at any stage, I must notify an official checkpoint or race official immediately. Should I fail to do so, triggering an unnecessary search-and-rescue operation, I agree to reimburse KISA and relevant rescue agencies for all associated operational costs.
I acknowledge that the Event takes place in an uncontrolled open ocean environment. While KISA implements safety briefings, course marshals, and water support, these measures represent reasonable operational precautions and do not constitute a guarantee of personal safety.
I agree to attend and listen closely to all pre-race safety briefings. I accept full personal responsibility for clarifying any instructions I do not understand with a race official prior to entering the water. I rely solely on my own judgment regarding my readiness to face course hazards.
I declare that all medical and physical health details provided during registration are accurate, complete, and current. I accept all risks associated with competing with any pre-existing medical conditions.
I accept ongoing responsibility to notify KISA administrators of any changes to my physical condition, medical status, or emergency contact information prior to the Event start.
I consent to receive any medical aid, first aid, or emergency transport (including ambulance, vessel, or helicopter evacuation) deemed necessary by event medical staff or safety crew. I accept full financial responsibility for all medical and evacuation costs incurred. Furthermore, race directors and water safety personnel reserve unconditional authority to remove any swimmer from the water if they deem the participant unfit or unsafe to continue.
Official swim courses are mapped to standard distances, but actual swam distances may vary due to tides, ocean currents, surface drift, and dynamic course alterations made for safety reasons. Swimmers must follow the designated course markers and directions issued on race day.
I agree to abide by all event rules, guidelines, and safety directives. The Race Director maintains absolute discretion to alter rules, adjust timing, impose cut-offs, or modify course tracks. All decisions by the Race Director are final and binding.
I agree to observe good sportsmanship at all times and uphold the standards of the Swimming Australia National Integrity and Safe Sport Framework. This standard of conduct applies throughout the event footprint, including pre-race briefings, island venues, competition waters, and associated post-event functions.
I agree to wear the official event-issued swim cap and an approved, high-visibility swim safety buoy/tow float as mandated by event regulations.
KISA, its contractors, and volunteers accept no liability for damage, loss, or theft of personal possessions or equipment brought to the venue, mainland transit points, or the island.
I grant KISA, its media partners, and commercial sponsors unrestricted, royalty-free, perpetual permission to capture and use my name, voice, biographical details, race results, photographs, and video footage in any media format worldwide for promotional, editorial, or commercial broadcasting purposes.
Additionally, by registering, I consent to my email address being added to the official KISA event mailing list for race updates, athlete briefings, and future event announcements. I understand that I may opt out or unsubscribe from these communications at any time via the unsubscribe link provided in the emails.
Except as explicitly outlined below, all registration fees are strictly non-refundable:
Transfer to Another Person: A registration may be transferred to a replacement participant for an administrative fee of $10 AUD, provided the substitute swimmer meets all applicable event prerequisites (including mandatory qualifying swim requirements) and completes official registration prior to the transfer deadline.
Transfer/Deferral to the Following Year: If you are unable to participate, you may defer your entry to the following year’s event. Upon deferral, you will receive a credit voucher entitling you to a 50% discount off the standard entry fee for that subsequent year’s event.
No Cash Refunds: Registrations are otherwise non-refundable if a participant is unable to take part, or if the event is altered or cancelled due to weather or Force Majeure conditions.
I consent to KISA sharing my name and contact details with official contracted event photography providers to facilitate delivery and purchasing options of race-day images.
I agree to receive official race communications, athlete updates, and relevant partner notices from KISA and Aqualification. I retain the option to unsubscribe from non-critical marketing communications.
The Race Director may alter course layouts, adjust starting times, shorten race distances, or alter event logistics at any time to preserve participant safety.
If the Event is cancelled, postponed, or curtailed due to adverse weather, tropical cyclones, high seas, floods, water contamination, dangerous marine life, or any other Force Majeure circumstance beyond KISA’s control, entry fees will not be refunded, as operational commitments have already been incurred.
If the Event is cancelled, delayed, or postponed, the race course is deemed formally closed. KISA will not provide water safety, medical personnel, or support craft. Any individual choosing to enter the water following a cancellation does so entirely at their own peril and without the sanction of KISA.
KISA reserves the right to decline or revoke entry, terminate access, or disqualify any participant at its discretion without refund if the individual fails to abide by event rules, acts unsafely, or conducts themselves in a manner detrimental to the organization, volunteers, or other participants.
Minimum Ages (as of race day):
20 km Individual Swim: Minimum 14 years of age.
Relay Teams and 6 km Swim: Minimum 12 years of age.
Entrants under 18 years of age must have their entry reviewed and executed by a parent or legal guardian. The consenting guardian acknowledges that open-water distance events require advanced physical conditioning and that proper supervision, preparation, and parental guidance are maintained.
This event is proudly brought to you by the Keppel Islands Swimming Association.
